MAINSTREAM COMMERCIAL A/C and REFRIGERATION PRODUCTS
Mainstream Engineering Corporation (“Mainstream”) expressly warrants its commercial A/C and refrigeration products to be free from defects if used properly and in accordance with the product’s use instructions and maintenance procedures. Mainstream warrants all components of its systems for one (1) year from the date of manufacture against defects in materials and workmanship. Mainstream will, at its option, replace or repair defective components. If components are replaced, Mainstream will, at its option use new or used components.
A unique serial number is assigned to each system. The serial number will be the final determination of identification of the warranted item. Standard warranty coverage excludes all costs associated with liquidated and/or consequential damages.
The complete warranty is as follows:
Subject to the conditions stated, Mainstream Engineering Corporation warrants its products to be free from defects in material and workmanship for a period of twelve (12) months from the date of manufacture.
Such warranty extends only to the original owner of the unit and is limited to Mainstream’s option to repair or replace with new, used, remanufactured parts or credit at invoice price any parts that are found to be defective under normal use and service within the specified warranty period. This warranty shall only cover labor and parts. Such repair or replacement shall be the Customer’s exclusive remedy and correction of defects in the above manner shall constitute complete fulfillment of all obligations and liabilities of Mainstream Engineering Corporation with respect to the unit sold, whether based in contract, in tort (including negligence and/or strict liability), or otherwise.
Any part of a unit which is repaired or furnished as a replacement under the terms of Mainstream Engineering Corporation’s Warranty shall be installed by an authorized Mainstream Engineering Corporation dealer or service affiliate without charge to the Customer for labor or parts. Any part which is replaced shall become the property of Mainstream Engineering Corporation. Such warranty services must be performed by an authorized Mainstream Engineering Corporation dealer or service affiliate and will not include overtime, mileage, telephone calls, or cost of transportation and/or relocation of equipment or service personnel.
Mainstream Engineering Corporation’s warranty does not include consumable or maintenance items, such as, but not limited to, oil, lubricants, filters and filter elements, cleaning materials, light bulbs, refrigerant gases, dryers, seals, paint, protective covers, labels, and batteries.
Mainstream Engineering Corporation’s warranty shall not apply to any unit which (i) has been so installed, maintained, repaired or altered as, in Mainstream Engineering Corporation’s judgment, to affect its integrity, (ii) has been subjected to misuse, negligent handling or accident, or (iii) has been operated, serviced or repaired contrary to Mainstream Engineering Corporation’s printed instructions. Mainstream Engineering Corporation or any authorized Mainstream Engineering Corporation dealer or service affiliate shall have the right to require that the Customer provide maintenance records to show that a unit has been properly maintained.
Mainstream’s customer service is the single point of contact for all warranty claims. Customer service can be reached via telephone, email, internet live chat, online form submission, or US Mail. The customer service representative will validate the warranty claim and determine the means to return the unit to service. All warranty repairs must be initiated by contacting Mainstream’s customer service department.
The customer is responsible for the removal of the Mainstream product from any system it may be attached to and shipped to Mainstream after receiving the proper return authorization from Mainstream’s customer service department. The unit will be serviced at Mainstream and returned to the customer free of charge, CONUS locations only, if the repair is covered by the warranty. If the repairs are not covered by warranty, the customer will be given a quotation to repair and return the unit. Mainstream must receive a purchase order to cover all non-warranty repairs.
Warning: Mainstream’s products are designed for use by technically trained Air Conditioning and Refrigeration Service Engineers only. Due to the high pressures encountered in these systems, plus the dangers due to the physical and chemical nature of refrigerants and oils present in the systems, misapplication could result in injury or death. Mainstream expressly warns against the sale to or use of the products by other than professionally trained personnel. Safety goggles should always be worn when working with refrigerants. Contact with refrigerants may cause injury.
LIMITATION OF WARRANTY
THE WARRANTY STATED ABOVE IS THE ONLY WARRANTY APPLICABLE TO THIS PRODUCT. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED ARE EXPRESSLY DISCLAIMED.
REPAIR OR REPLACEMENT AS PROVIDED UNDER THIS WARRANTY `IS THE EXCLUSIVE REMEDY OF THE PURCHASER, USER OR ANY OTHER AFFECTED PARTY. MAINSTREAM SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHATSOEVER, WHETHER IN CONTRACT OR TORT (INCLUDING NEGLIGENCE OR STRICT LIABILITY), RESULTING FROM, OR IN ANY WAY RELATED TO, THE PURCHASE, PROPER OR IMPROPER USE OR DISPOSAL OF THE PRODUCT.
